The Science Gap in Criminal Justice: Why Access to Forensic Experts Shouldn't Depend on Where You're Charged

Scientific evidence has become one of the most powerful forces in today's criminal justice system. Blood alcohol testing, DNA analysis, drug chemistry, toxicology, and digital forensics frequently determine whether someone is convicted or acquitted. Yet one troubling reality receives surprisingly little attention:

Not every defendant has equal access to the scientific expertise needed to evaluate that evidence.

The Medusa Analytical team believes that justice depends on more than the availability of scientific evidence—it depends on the ability to independently examine that evidence. Unfortunately, across the United States, access to qualified forensic experts often depends not on the merits of a case, but on the state in which it is prosecuted.

Science Should Be Neutral

Every forensic scientist should share a common mission: follow the science wherever it leads.

Our work isn't about advocating for one side or the other. It's about determining whether laboratory procedures were properly followed, whether accepted scientific methodologies were used, and whether the conclusions presented in court are actually supported by the evidence.

In every case we review, someone's liberty is at stake. Scientific evidence deserves the same scrutiny as any other form of evidence because mistakes—whether during collection, testing, or interpretation—can have life-changing consequences.

The Promise of Ake v. Oklahoma

More than forty years ago, the United States Supreme Court recognized an important constitutional principle.

In Ake v. Oklahoma (1985), the Court held that when expert assistance is reasonably necessary for a fair trial, indigent defendants are entitled to state-funded expert services. That principle extends beyond psychiatry to include forensic disciplines such as:

  • Blood alcohol testing

  • Forensic toxicology

  • Cannabis analysis

  • Controlled substance identification

  • Analytical chemistry

  • Other specialized scientific fields

The goal was straightforward: justice should not depend on a defendant's financial resources.

A Patchwork System Across the Country

While the constitutional principle exists nationwide, its implementation varies dramatically.

Some states have established statutory mechanisms that provide funding for independent forensic experts in indigent defense cases. Others acknowledge the right in theory but make obtaining funding difficult, requiring extensive necessity hearings or imposing procedural hurdles that delay or effectively prevent expert review.

In some jurisdictions, meaningful funding may be unavailable altogether.

The result is an uneven system where a defendant's access to independent scientific review may depend more on geography than on fairness.

The State Already Controls Much of the Science

In most criminal prosecutions involving forensic evidence, the government begins with significant advantages.

State agencies generally control:

  • Crime laboratories

  • Laboratory personnel

  • Instrumentation

  • Testing data

  • Evidence handling

  • Laboratory records

Independent experts often must request additional documentation—including maintenance records, calibration data, quality control records, chain-of-custody documentation, and instrument logs—to fully evaluate whether accepted scientific practices were followed.

Without access to those materials—and without qualified experts to interpret them—it becomes far more difficult to assess the reliability of the evidence presented in court.

Why Independent Review Matters

Independent forensic review is far more than simply reading a laboratory report.

It requires scientists with advanced education and specialized expertise who understand:

  • Analytical chemistry

  • Laboratory quality assurance

  • Instrument validation

  • Method development

  • Forensic toxicology

  • Laboratory accreditation standards

  • Scientific error detection

Reviewing forensic evidence means evaluating not only whether testing was performed, but whether it was performed correctly—and whether the conclusions drawn are scientifically justified.

When Funding Systems Break Down

Expert review requires significant time, specialized knowledge, and highly trained professionals.

When states lack reliable funding mechanisms for indigent defense experts, private forensic consulting firms may be forced to absorb the financial risk of performing complex scientific reviews without assurance of compensation.

For many firms, that simply is not sustainable.

As a result, some firms are unable to accept cases in jurisdictions where expert funding remains uncertain—not because the science is less important, but because the underlying funding structure makes the work financially impossible to provide consistently. 

Justice Should Not Depend on Geography

Scientific evidence should be evaluated according to accepted scientific principles—not according to where a case happens to be prosecuted.

Reliable forensic review strengthens the justice system for everyone. It helps identify laboratory errors when they occur, reinforces confidence when procedures were properly followed, and ensures that scientific testimony presented in court is based on sound methodology.

When access to independent experts varies dramatically from one jurisdiction to another, so too may access to meaningful scientific review.
